Welcome to AuctionsDuka. These Terms and Conditions govern your access to and use of the AuctionsDuka platform (accessible at auctionsduka.comand via the AuctionsDuka mobile applications on iOS and Android). AuctionsDuka is a technology marketplace platform operated by NCBA Leasing LLP (“AuctionsDuka,” “we,” “us,” or “our”), a subsidiary of NCBA Group PLC.
AuctionsDuka provides the digital infrastructure through which Sellers and Buyers transact. AuctionsDuka does not itself sell, auction, or transfer ownership of any goods or property listed on the platform — all sales are conducted by Sellers (or their appointed licensed auctioneers) in their own right. By accessing or using AuctionsDuka, you (“User,” “you,” or “your”) agree to be bound by these Terms. If you do not agree, you must immediately cease using the platform.
AuctionsDuka is part of the Duka Marketplaces Ecosystem, which also includes CarDuka and PropertyDuka. Your AuctionsDuka Account may grant you access to these other platforms under their respective Terms and Conditions.
1. Definitions
In these Terms and Conditions, the following words and expressions shall have the meanings assigned to them below, unless the context otherwise requires:
2. Account Registration and Eligibility
2.1 Eligibility
To create an Account, you must:
- (a)Be at least eighteen (18) years of age or the age of legal majority in your jurisdiction, whichever is higher;
- (b)Have the legal capacity to enter into a binding agreement;
- (c)Provide accurate, current, and complete registration information; and
- (d)Not have been previously suspended or removed from AuctionsDuka or any Duka Marketplace for violation of these Terms.
Where a User registers on behalf of a corporate entity, partnership, or other organisation, the User represents and warrants that they have the authority to bind that entity to these Terms.
2.2 Identity Verification
All Users are required to verify their identity through AuctionsDuka's verification process, which integrates with Kenya's Integrated Population Registration System (IPRS) to validate National ID numbers and registered phone numbers. This verification is a prerequisite for engaging in Transactions on the platform.
2.3 Linked Accounts Across Duka Marketplaces
AuctionsDuka is part of the Duka Marketplaces Ecosystem, which also includes CarDuka and PropertyDuka. Your Account credentials may grant you access to other Duka Marketplaces platforms using the same registration details. Your profile information, verification status, and trust ratings may be shared across these platforms to enable a seamless experience. Each marketplace is governed by its own Terms and Conditions.
2.4 Account Security
You are solely responsible for maintaining the confidentiality of your Account credentials (including your PIN) and for all activities that occur under your Account. You agree to:
- (a)Create a strong PIN/password and not share it with any third party;
- (b)Immediately notify AuctionsDuka of any unauthorised access to or use of your Account at hello@auctionsduka.com;
- (c)Ensure that you log out of your Account at the end of each session, particularly when accessing the platform from shared or public devices; and
- (d)Accept responsibility for any losses arising from your failure to comply with these security obligations.
AuctionsDuka reserves the right to suspend or terminate any Account that we reasonably believe has been compromised, is being used fraudulently, or is in violation of these Terms.
3. Data Protection and Privacy
AuctionsDuka processes your personal data in accordance with the Data Protection Act, 2019 of Kenya. Full details of how we collect, use, share, and protect your personal data are set out in our Privacy Policy, which forms part of these Terms. Key points are summarised below.
3.1 Data Controller
AuctionsDuka (operated by NCBA Leasing LLP, a subsidiary of NCBA Group PLC) is the Data Controller for Personal Data collected through this platform. Our Data Protection Officer can be contacted at DataProtection@ncbagroup.com. NCBA Leasing LLP is registered as a Data Controller with the Office of the Data Protection Commissioner.
3.2 Lawful Basis for Processing
- (a)Consent — Where you have given explicit consent for a specific processing purpose, such as marketing communications or sharing data with third-party service providers.
- (b)Contract — Where processing is necessary for the performance of the contract between you and AuctionsDuka, including account registration, identity verification, facilitating Transactions, and providing platform services.
- (c)Legal Obligation — Where processing is necessary for compliance with legal obligations, including anti-money laundering regulations, tax reporting, and regulatory filings.
- (d)Legitimate Interest — Where processing is necessary for AuctionsDuka's legitimate interests, such as fraud prevention, platform security, service improvement, and analytics.
3.3 Categories of Personal Data Collected
- (a)Identity information (full name, date of birth, National ID number, passport number, KRA PIN);
- (b)Contact information (email address, phone number, physical address);
- (c)Financial information (bank account details, M-PESA details, payment history, credit assessment data where financing is applied for);
- (d)Device and technical information (IP address, browser type, device identifiers, cookies, app version);
- (e)Transaction data (listing details, bid history, purchase records, financing applications);
- (f)Location data (GPS coordinates, IP-based geolocation);
- (g)Communication data (messages exchanged through the platform, support queries, chatbot interactions); and
- (h)Verification data (IPRS validation records, business documentation).
3.5 Data Subject Rights
In accordance with Section 26 of the Data Protection Act, 2019, you have the right of access, right to rectification, right to erasure (subject to legal retention obligations), right to restrict processing, right to data portability, and right to object. To exercise any of these rights, contact DataProtection@ncbagroup.com or hello@auctionsduka.com. We will acknowledge your request within seven (7) days and respond substantively within thirty (30) days.
3.6 Data Retention and Security
We retain your Personal Data only for as long as necessary to fulfil the purposes for which it was collected, or as required by applicable law. As an entity within a financial services group regulated by the Central Bank of Kenya, certain records may be retained for a minimum of seven (7) years. We implement banking-grade security standards including encryption in transit and at rest, access controls, regular security audits, and staff training.
3.7 Cross-Border Data Transfers
In the event that your Personal Data needs to be transferred outside Kenya, we will ensure adequate safeguards are in place as required by Section 48 of the Data Protection Act, 2019, and ensure at least one serving copy of your data is stored on a server or data centre located in Kenya.
3.8 Breach Notification
In the event of a Personal Data breach, AuctionsDuka will notify the Office of the Data Protection Commissioner within seventy-two (72) hours of becoming aware of the breach, and will notify affected Users in writing within a reasonably practical period where the breach poses a high risk to their rights and freedoms.
3.9 Cookies and Tracking Technologies
The platform uses cookies and similar tracking technologies to enhance your experience, analyse usage patterns, and deliver personalised content and AI-powered recommendations. You may manage your cookie preferences through your browser or app settings. Full details are in our Cookie Policy.
4. User Conduct and Prohibited Activities
4.1 General Conduct
Users agree to use AuctionsDuka lawfully, ethically, and in good faith. You shall not use the platform in any manner that could damage, disable, overburden, or impair its operation or interfere with any other User's use and enjoyment of the platform.
4.2 Prohibited Activities
The following activities are strictly prohibited:
- (a)Fraud and Misrepresentation — Posting false, misleading, or deceptive Listings or Content; misrepresenting the condition, ownership, or characteristics of any item; providing false verification documents.
- (b)Illegal Activity — Using the platform to facilitate any activity that violates the laws of Kenya or any applicable jurisdiction, including money laundering, terrorism financing, tax evasion, and trafficking in prohibited goods.
- (c)Intellectual Property Infringement — Listing counterfeit goods; using another party's trademarks, copyrighted material, or proprietary information without authorisation.
- (d)Spam and Abuse — Sending unsolicited commercial communications; posting repetitive or irrelevant Content; manipulating search results, rankings, or AI recommendation algorithms.
- (e)Circumvention — Attempting to bypass security measures, identity verification, access controls, or other protective mechanisms; using automated tools (bots, scrapers) to extract data without authorisation.
- (f)Harassment — Engaging in abusive, threatening, discriminatory, or harassing behaviour towards other Users or staff.
- (g)Off-Platform Transactions — Soliciting or encouraging Transactions outside the platform to avoid fees, protections, verification, or audit trails.
- (h)Shill Activities — Placing bids on one's own items, using secondary accounts to manipulate pricing or reviews, or colluding with other Users to distort marketplace dynamics.
4.3 Enforcement
AuctionsDuka reserves the right, at its sole discretion, to investigate, warn, suspend, or permanently terminate the Account of any User who violates these Terms. We may remove or disable access to any Content or Listing that breaches these Terms, report illegal activity to relevant law enforcement authorities, and pursue legal remedies as appropriate. Enforcement action may apply across the entire Duka Marketplaces Ecosystem.
5. Intellectual Property
5.1 Our Intellectual Property
All intellectual property in AuctionsDuka, including platform software, website design, logos, trademarks, trade dress, text, graphics, AI algorithms, and underlying technology, is the exclusive property of NCBA Leasing LLP and/or NCBA Group PLC or their licensors and is protected under the laws of Kenya and international intellectual property conventions. No part of the platform may be reproduced, distributed, modified, reverse-engineered, or commercially exploited without prior written consent.
5.2 User Content
By posting Content on AuctionsDuka, you grant us a non-exclusive, worldwide, royalty-free, transferable, sublicensable licence to use, reproduce, modify, display, distribute, and create derivative works from such Content for the purposes of operating, promoting, and improving the platform and the Duka Marketplaces Ecosystem. This includes use in AI-powered tools and recommendation engines.
5.3 Takedown Procedure
If you believe that any Content on the platform infringes your intellectual property rights, please submit a written notice to hello@auctionsduka.com including:
- (a)Identification of the work claimed to be infringed;
- (b)Identification of the allegedly infringing Content;
- (c)Your contact information;
- (d)A statement of good faith belief that the use is unauthorised; and
- (e)A declaration under penalty of perjury that the information is accurate.
6. Fees, Payments and Taxes
6.1 Platform Fees
AuctionsDuka may charge fees for the use of certain services, including but not limited to listing fees, transaction commissions, subscription fees, premium placement fees, bidding fees, buyer's premiums, and value-added services. The applicable fee schedule is published on the platform.
6.2 Payment Methods
Payments may be processed through approved payment channels, including M-PESA and other mobile money platforms, bank transfers, credit and debit card payments, NCBA banking products, and such other methods as may be made available from time to time.
6.3 Taxes
Users are solely responsible for determining and fulfilling their tax obligations arising from Transactions, including Value Added Tax (VAT), income tax, withholding tax, Capital Gains Tax, stamp duty, and any other applicable levies. AuctionsDuka may be required to collect and remit certain taxes on behalf of Users in accordance with the Tax Procedures Act, 2015 and Kenya Revenue Authority directives.
7. Limitation of Liability
7.1 Role of AuctionsDuka
AuctionsDuka operates as a technology marketplace operator and is not itself a seller, auctioneer, or party to Transactions between Buyers and Sellers. AuctionsDuka does not sell, offer for sale, or conduct auctions of any goods or property on the platform. All sales and auctions are conducted by Sellers (or their appointed licensed auctioneers) in their own right. AuctionsDuka provides platform services only and does not guarantee the quality, safety, legality, title, or availability of any goods, property, or services listed on the platform. Buyers transact directly with Sellers.
7.2 Disclaimer of Warranties
THE PLATFORM IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. AUCTIONSDUKA DOES NOT WARRANT THAT THE PLATFORM WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
7.3 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY THE LAWS OF KENYA, AUCTIONSDUKA'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR IN CONNECTION WITH THESE TERMS OR YOUR USE OF THE PLATFORM SHALL NOT EXCEED THE TOTAL FEES PAID BY YOU TO AUCTIONSDUKA IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM. IN NO EVENT SHALL AUCTIONSDUKA BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
7.4 Indemnification
You agree to indemnify, defend, and hold harmless AuctionsDuka (NCBA Leasing LLP), NCBA Group PLC, their directors, officers, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses arising from:
- (a)Your use of the platform;
- (b)Your violation of these Terms;
- (c)Your violation of any third party's rights; or
- (d)Any Content you post on the platform.
8. Dispute Resolution
8.1 Between Users
Disputes arising between Users in connection with a Transaction shall be resolved in the first instance between the relevant parties. Where a Buyer reports a material discrepancy between the item received and its listing description, the Buyer must notify AuctionsDuka at hello@auctionsduka.com within seventy-two (72) hours of collection or delivery. AuctionsDuka will escalate the complaint to its internal dispute team, which will investigate and communicate a determination to both parties within ten (10) working days. AuctionsDuka's dispute determination is final as between the parties for platform enforcement purposes, but does not prejudice either party's right to seek legal redress. Users may also lodge complaints with the Competition Authority of Kenya (CAK).
8.2 Between Users and AuctionsDuka
Any dispute arising out of or in connection with these Terms or the use of the platform shall be resolved as follows:
- (a)Negotiation — The parties shall first attempt to resolve the dispute through good faith negotiation within thirty (30) days of written notice.
- (b)Mediation — If negotiation fails, the parties shall submit the dispute to mediation under the Nairobi Centre for International Arbitration (NCIA) Mediation Rules.
- (c)Arbitration — If mediation fails, the dispute shall be referred to and finally resolved by arbitration under the NCIA Arbitration Rules. The seat shall be Nairobi, Kenya, and the language shall be English.
8.3 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Kenya.
9. General Provisions
9.1 Amendments
AuctionsDuka reserves the right to amend these Terms at any time. Material changes will be communicated through the platform or via email at least fourteen (14) days before taking effect. Continued use constitutes acceptance.
9.2 Severability
If any provision of these Terms is held invalid or unenforceable, the remaining provisions continue in full force and effect.
9.3 Entire Agreement
These Terms and Conditions, together with the Privacy Policy, Cookie Policy, and any other policies referenced herein, constitute the entire agreement between you and AuctionsDuka regarding your use of the platform.
9.4 Waiver
No failure or delay by AuctionsDuka in exercising any right under these Terms shall constitute a waiver of that right.
9.5 Assignment
You may not assign or transfer your rights or obligations under these Terms without prior written consent. AuctionsDuka may assign its rights and obligations to any affiliate or successor entity within the NCBA Group.
9.6 Force Majeure
AuctionsDuka shall not be liable for any failure or delay in performing its obligations due to circumstances beyond its reasonable control, including natural disasters, pandemics, government actions, cyber attacks, telecommunications failures, or failures of third-party service providers.
9.7 Notices
All notices may be delivered electronically through the platform, by email to the address associated with your Account, or by registered post.
10. Scope of AuctionsDuka Services
10.1 Purchasing Modes
- (a)Auction (Bid Now) — Competitive bidding where the highest bidder at auction close wins the item, subject to any reserve price.
- (b)Buy Now (Fixed Price) — Immediate purchase at a set price without bidding.
- (c)Lease Now — Asset lease arrangement powered by NCBA Bank, subject to credit assessment.
10.2 Asset Categories
- (a)Electronics and Phones;
- (b)Furniture and Appliances;
- (c)Agri and Industrial;
- (d)Solar and Medical Equipment;
- (e)Motor Vehicles (cross-listed with CarDuka where applicable);
- (f)Real Estate and Land (cross-listed with PropertyDuka where applicable); and
- (g)General Merchandise.
10.3 Condition Grading
Items may carry condition indicators (“Brand New,” “Refurbished,” “Used”). These are provided by the Seller and are general guidance only. AuctionsDuka does not independently verify condition ratings.
10.4 Key Features
- (a)BidwizAI — AI-powered assistant for auction guidance. Informational only, not professional advice.
- (b)Auction Alerts — Notifications for items matching your interests. Manage via Account settings.
- (c)Request an Item — Submit requests for specific items. No guarantee of fulfilment.
- (d)Sell with Us — Seller onboarding for consigning assets.
- (e)Featured Auctions / Auction of the Week — Promoted Listings. Not an endorsement.
11. Bidder Registration and Eligibility
In addition to the standard Account, bidders must:
- (a)Complete bidder registration including enhanced verification;
- (b)Accept auction-specific conditions;
- (c)Provide a valid payment method; and
- (d)Where required, pay a refundable registration deposit.
By registering, you warrant that you have the financial capacity to fulfil obligations if your bid is successful.
12. Auction Rules and Bidding Process
12.1 General Rules
- (a)Binding Bids — Each bid is a legally binding offer to purchase. Bids may not be retracted.
- (b)Bid Increments — Minimum increments are displayed on the auction page.
- (c)Reserve Price — Items may have undisclosed reserve prices.
- (d)Auction Duration — As specified. AuctionsDuka may extend, shorten, suspend, or cancel any auction.
- (e)Auto-Extend — Late bids may trigger automatic time extensions.
- (f)Winning Bidder — The highest bidder at close, meeting any reserve, wins. AuctionsDuka's identification of the winning bidder is final and binding for platform administration purposes, acting as agent for the Seller in recording the auction outcome.
12.2 Buy Now Transactions
Buy Now purchases are binding once confirmed. If an item has both Auction and Buy Now options, a Buy Now purchase immediately ends the auction.
12.3 Lease Now Transactions
Lease Now expressions of interest are not binding until a lease agreement is executed. The item may continue to be available for bidding until a lease is signed.
12.4 Shill Bidding
Shill bidding and all forms of bid manipulation are strictly prohibited and will result in immediate account termination across the entire Ecosystem, forfeiture of deposits, and potential law enforcement referral.
12.5 Proxy and Maximum Bidding
AutoBid enters a maximum amount and the system bids on your behalf in minimum increments. Each system-placed bid incurs a separate Bidding Fee. The earlier-placed bid takes priority in a tie.
13. Bidding Fees
13.1 Per-Bid Fee
AuctionsDuka charges a non-refundable fee each time a bid is placed (“Bidding Fee”). By placing a bid, you acknowledge the Bidding Fee will be charged immediately, regardless of whether you win.
13.2 Fee Structure
Bidding Fees are tiered by bid type:
- (a)Normal Bid — A standard manual bid, charged at the published Normal Bid rate.
- (b)AutoBid — Each individual bid placed by the AutoBid system incurs a separate Bidding Fee at the published AutoBid rate. Users acknowledge that AutoBid may result in multiple bids and multiple fees.
Current rates are displayed on the platform fee schedule prior to bid placement.
13.3 Non-Refundable
All Bidding Fees are non-refundable, regardless of outcome, including:
- (a)You are outbid;
- (b)The reserve price is not met;
- (c)The Seller withdraws the item; or
- (d)You choose not to complete the purchase after winning.
Notwithstanding the foregoing, where AuctionsDuka cancels an auction due to a technical failure or error on AuctionsDuka's own systems, or due to a verified fault on the part of the Seller (including fraudulent or materially misdescribed listings), Bidding Fees paid in respect of that auction will be refunded to the affected bidders. Refunds under this carve-out are AuctionsDuka's sole liability in such circumstances.
13.4 Fee Disclosure and Consent
The applicable fee is displayed before each bid is confirmed. By clicking "Bid Now," "Place Bid," or "Confirm AutoBid," you expressly consent to the immediate charge. A record of all fees is available in your Account transaction history.
13.5 Payment, Taxes, and Changes
Bidding Fees are payable through available payment methods (M-PESA, card, Account balance). Failed payment means the bid is not placed. Fees may be subject to VAT. AuctionsDuka reserves the right to modify the fee structure on fourteen (14) days' notice; changes apply to bids placed after the effective date.
14. Post-Auction and Post-Purchase Obligations
14.1 Payment
The winning bidder or buyer must pay the full price plus any buyer's premium, fees, and taxes within forty-eight (48) to seventy-two (72) hours. Failure to pay may result in deposit forfeiture, the item being re-offered, liability for resale shortfall, and Account suspension.
14.2 Buyer's Premium
A buyer's premium may be charged on top of the winning bid or Buy Now price, as stated in the auction conditions.
14.3 Collection and Delivery
Items must be collected within the stated timeframe. Late collection may incur storage charges. Uncollected items may be resold at the buyer's risk.
15. Item Descriptions and Condition
15.1 As-Is, Where-Is
Unless stated otherwise (e.g., “Brand New” with manufacturer's warranty), items are sold “AS IS, WHERE IS” with all faults. No warranties are given except where explicitly stated by the Seller.
This “as is” provision applies to used, refurbished, and repossessed goods and does not affect any statutory rights you may have under the Consumer Protection Act, 2012 (No. 46 of 2012), including rights applicable to goods listed as “Brand New” which may carry manufacturer warranties that cannot be excluded.
15.2 Inspection
Bidders are strongly encouraged to inspect items before bidding. A bid or purchase constitutes acknowledgement that the User had a reasonable opportunity to inspect or chose to proceed without inspection.
16. Seller Obligations
Sellers must:
- (a)Be the legal owner or have authority to sell;
- (b)Provide accurate condition information and apply correct condition indicators;
- (c)Disclose encumbrances;
- (d)Cooperate with inspections and photography;
- (e)Honour the sale at the agreed price;
- (f)Facilitate timely transfer; and
- (g)Comply with all applicable tax and consumer protection requirements.
17. NCBA Verified Seller Badge
17.1 What Is the NCBA Verified Seller Badge?
The NCBA Verified Seller Badge is a visual trust indicator displayed on select Seller profiles on AuctionsDuka. It signifies that the Seller has been screened through NCBA's internal due diligence process and approved to list items on the platform as a Seller from whom Buyers may be eligible to access NCBA financing products. It also confirms that the Seller's business is registered.
17.3 What the Badge Does Not Guarantee
The NCBA Verified Seller Badge is not a guarantee of the condition, quality, authenticity, ownership, or pricing of any item listed by a Verified Seller. Verification is of the Seller's profile and business registration only. Neither NCBA Leasing LLP nor NCBA Bank Kenya Limited acts as an intermediary in the actual sale or auction transaction. Buyers must still complete their own due diligence on any item before placing a bid or making a purchase.
17.4 Badge Eligibility and Revocation
The NCBA Verified Seller Badge is awarded at NCBA's sole discretion following its internal due diligence review. Badge status is not permanent. NCBA periodically reviews its panel of approved Sellers, and a Seller's verified status may be revoked if they no longer meet the eligibility requirements, their business registration lapses, or they are found to be in breach of these Terms. Badge status shown on the platform reflects current status at the time of display and may change without prior notice to Buyers.
17.5 No Liability for Badge Decisions
AuctionsDuka and NCBA Leasing LLP accept no liability for any loss or damage arising from a Buyer's reliance on the presence or absence of the NCBA Verified Seller Badge. The badge is an informational indicator only. It does not create any warranty, representation, or guarantee on the part of AuctionsDuka or any NCBA Group entity in respect of the item, the transaction, or the Seller's conduct.
18. Financial Services Hub
AuctionsDuka integrates a Financial Services Hub that provides access to financial products offered by NCBA Bank Kenya Limited, a licensed commercial bank regulated by the Central Bank of Kenya (CBK), and by approved third-party providers. AuctionsDuka acts as a marketing and referral channel only; it is not the lender, insurer, or financial services provider. All financial products are subject to NCBA Bank Kenya Limited's own terms and conditions, credit assessment, and applicable CBK consumer protection guidelines:
- (a)Business Loans — Up to 80% on business assets.
- (b)Personal Loans — Unsecured personal loans.
- (c)Asset Lease — Flexible equipment leasing.
- (d)Insurance — General, Health, and Life insurance.
- (e)NCBA Bank Account — No monthly fees.
- (f)Finance Calculator — Estimate loan repayments and affordability.
All products are provided by NCBA Bank Kenya Limited or approved third-party providers. AuctionsDuka is not responsible for any credit decision, policy term, or product outcome. In the event of any dispute relating to a financial product, your recourse is directly against NCBA Bank Kenya Limited or the relevant provider, and not against AuctionsDuka.
19. Auction Cancellation and Withdrawal
AuctionsDuka may, acting in its capacity as platform operator and as agent for the Seller, exercise the following administrative powers in order to protect the integrity of the marketplace:
- (a)Withdraw a listing before auction close where required by the Seller or where AuctionsDuka reasonably suspects fraud, illegality, or a breach of these Terms;
- (b)Suspend or cancel an auction due to verified technical failures, fraud, or regulatory requirements;
- (c)Annul a purported sale where bid manipulation, shill bidding, or other prohibited conduct has been detected; and
- (d)Re-offer items where a winning bidder fails to complete payment.
These powers are exercised on behalf of the Seller and/or in the interests of the marketplace, not as acts of sale or auction by AuctionsDuka. Where AuctionsDuka cancels an auction due to its own technical failure, its liability is limited to refunding registration deposits and Bidding Fees paid in respect of that auction as set out in Section 13.3.
20. AuctionsDuka-Specific Disclaimers
In addition to the disclaimers above:
- (a)Item descriptions, photographs, and condition indicators may contain errors and are provided by the Seller, not AuctionsDuka;
- (b)AuctionsDuka is not responsible for loss or damage between auction close and collection;
- (c)No guaranteed auction outcomes;
- (d)Technical issues may affect bidding, and AuctionsDuka's administrative determinations (including identification of the winning bidder and auction outcome recording) are final for platform purposes, acting as agent for the Seller;
- (e)All Sellers, including banks, leasing companies, and other financial institutions disposing of repossessed or consigned assets, conduct sales in their own right — AuctionsDuka is the marketplace operator only and is not the seller, consignor, or auctioneer;
- (f)Financial Services Hub products are subject to provider approval;
- (g)BidwizAI outputs are AI-generated and informational only, do not constitute professional valuation or financial advice, and users should not rely solely on BidwizAI for material purchasing decisions;
- (h)Auction Alerts are a convenience with no delivery guarantee; and
- (i)All Bidding Fees are non-refundable subject to the carve-out in Section 13.3.
